Lindsay Clancy's lawyer shot down in big request regarding lone holdout juror
Plymouth, Massachusetts - Lindsay Clancy's attorney has been denied in his attempt to investigate Michael Desronvil, the lone holdout juror in his client's closely watched murder trial.
On Wednesday, Judge William Sullivan rejected defense attorney Kevin Reddington's request to access Desronvil's questionnaire, have his phone independently examined, and question him in court.
Reddington had argued that an inquiry was necessary to determine whether the juror had lied during jury selection, improperly used his cell phone during deliberations, or failed to follow the judge's instructions.
In his ruling, Sullivan emphasized that concerns about Desronvil's cell phone use and possible dishonesty only came to light after the mistrial was declared.
"Because post-trial information potentially affecting Juror Doe's impartiality cannot be used to attack the determination that a mistrial was manifestly necessary, Clancy is not entitled to an evidentiary hearing on that issue," Sullivan ruled, per The Boston Globe.
Sullivan called a mistrial on September 4 after the jury could not come to a unanimous decision. The jury was reportedly split 11-1 in favor of finding Clancy not criminally responsible for the killings of her three children due to postpartum psychosis.
After the trial, Desronvil's fellow jurors publicly accused him of refusing to vote for a not-guilty verdict despite having "reasonable doubt."
Desronvil, meanwhile, said in a recent interview that he stands by his vote to convict Clancy and denied ever lying under oath.
He also said that all jurors had access to their cell phones but that they were only used during breaks, not during deliberations.
Clancy will return to the courtroom next month, where Reddington is expected to argue that putting Clancy on trial again would constitute double jeopardy.
