Carson City, Nevada – The majority of Nevada voters on Tuesday said yes to amending the state constitution to include the right to abortion.
Abortion was on the ballot in four states this midterm cycle: Idaho, Missouri, Virginia, and Nevada.
On Tuesday, 62% of Nevada voters said yes to Question 6, as reported by the Associated Press.
The measures will make abortion a right until fetal viability, or when needed to protect the life or health of the pregnant person.
While abortion was already legal in Nevada, codifying it as part of the state constitution further protects access to health care.
Abortion was on the Nevada ballot in 2024 and passed. With its passage in this election, the initiative meets the requirements for a constitutional amendment.
Existing laws are more subject to legislative whim than rights that are codified in the state constitution.
In other words, abortion is now a right until fetal viability, which is usually considered to be 24 weeks, or in cases in which an abortion would protect the life or health of the pregnant person.
Per Question 6, abortion in Nevada cannot be denied, burdened, or infringed upon unless justified by a compelling state interest, which would be defined as "an interest which is limited exclusively to the state's interest in protecting, maintaining, or improving the health of an individual who is seeking abortion care that is consistent with accepted clinical standards of practice."
