Days after publicly slamming her husband Ne-Yo (42) in a since-deleted Instagram post for being unfaithful, Crystal Smith has officially submitted a petition to end their marriage once and for all.

According to docs obtained by TODAY, Smith claimed that the 42-year-old "recently fathered a minor child with his paramour," and also noted that the pair have been separated since July 22.

The docs were filed in Fulton County, Georgia, where Smith lives. The mother to three of Ne-Yo's children is arguing that she's entitled to a divorce because "the marriage is irretrievably broken with no hope for reconciliation."

In the filing, Smith also asked for temporary and permanent alimony, the division of property, and primary custody of their three kids: Shaffer (6), Roman (4), and Isabella (1). Additionally, she asked that Ne-Yo be required to pay monthly child support.

"It is in the best interests of the minor children that Petitioner be granted primary physical custody of the minor children, and that the parties share joint legal custody of the minor children, on a temporary and permanent basis," the petition read.

Smith first sounded the alarm about trouble in her marriage in a rant on IG where she hinted at leaving Ne-Yo: "I choose me, I choose my happiness and health and my respect."

The So Sick singer broke his silence on the matter shortly after, tweeting, "Personal matters are not meant to be addressed and dissected in public forums. I simply ask that you please respect me and my family’s privacy at this time."

Neither Smith nor Ne-Yo have publicly commented on the divorce filing.
