Plymouth, Massachusetts - Lindsay Clancy's defense attorney, Kevin Reddington, called for the dismissal of a juror he said "spurned the instructions" Thursday amid deliberations in the closely watched murder trial.
On the sixth day of deliberations, things took another dramatic turn as Judge William Sullivan questioned jurors individually in a long sidebar that also saw Lindsay Clancy pulled into discussions, per CBS News.
Judge Sullivan then reminded the jury to follow his previously outlined discussions and repeated the definition of reasonable doubt.
But as the jurors were sent back to deliberations, Reddington urged the judge to "remove this juror that refuses to listen to your instruction on reasonable doubt."
He referred to a note handed in by the jury foreperson that reportedly singled out a juror who "refuses to listen to the law" the judge provided on the matter of reasonable doubt.
"If we come back in a half hour with a mistrial because of a juror that has just spurned the instructions of this court, it's a shame," the defense attorney said. "It's a real shame."
Judge Sullivan ultimately chose not to remove any jurors and ordered them to resume deliberations.
The jury told the judge they were deadlocked twice earlier this week – once on Tuesday and again on Wednesday.
Judge Sullivan employed what is known as a "dynamite charge," reminding the jury of their instructions in the hopes of reaching a verdict and avoiding a hung jury.
