The news comes three days before Cuomo was set to answer to the sexual harassment charges in court.

In a statement, Soares said, "While we found the complainant in this case cooperative and credible, after review of all the available evidence, we have concluded that we cannot meet our burden at trial."

He continued, "Although avenues for criminal prosecution in these cases are sometimes limited, I encourage victims of workplace harassment and abuse to continue to come forward and bring these issues to light."

On December 28, Westchester County District Attorney, Miriam E. Rocah, opted to drop criminal charges against Cuomo.

"My Office has determined that, although the allegations and witnesses were credible, and the conduct concerning, we cannot pursue criminal charges due to the statutory requirements of the criminal laws of New York," Rocah said in a statement.

On August 3, an investigation into several sexual misconduct allegations against Cuomo found that the former governor did, in fact, "[Violate] multiple state and federal laws, as well as the executive chamber's own written policies," regarding sexual harassment.

On August 10, roughly one week after the report was published, the politician officially resigned from his role as governor.

On October28, Cuomo was formally charged for a misdemeanor sex-crime offense by the Albany City Court.

Cuomo has consistently denied all allegations of sexual misconduct to this day.
